CONSENT TO PROCESS (USE) PERSONAL INFORMATION IN TERMS OF THE PROTECTION OF PERSONAL INFORMATION ACT (POPIA) ACT 4 OF 2013 IN RESPECT OF A TRANSFER OF IMMOVABLE PROPERTY

The personal information which is processed by JA Coetzee Attorneys (“the firm”) in the course of your engagement of our services falls within the ambit of the POPIA.
The purpose of this document is to obtain your consent to process your personal information.
By your signature hereto, you confirm that you are aware of the fact that you are under no obligation to consent to the processing of your personal information by our firm and that your consent relates only to the processing of your personal information pertaining to the matters stated herein.
For purposes of defining “personal information,” you are advised that such information may include your:
full names, surname, and identity number
contact details, such as e-mail address, website address, postal address, landline, and mobile contact numbers, geographic location
marital status
number of dependants
place of residence
employment details and history
business, assets, and financial information
bank account details
next-of-kin details
correspondence which is private or confidential
all information relating to the requirements set out in the Financial Intelligence Centre Act, 38 of 2001, as amended, with which the firm is obliged to comply
any other information requested by us and voluntarily provided by you for purposes of performing the services in accordance with your mandate to the firm.

I (“the Client”) when i provide any of my details to this website i hereto grant my consent to the firm to:
Process my personal information for purposes of rendering the services. Collect my personal information from any third party or source for purposes of rendering the services. Record, store, update, modify, retrieve, disseminate, and use my personal information for purposes of rendering the services. Transmit, distribute (including distribution to a third party in a foreign country), publish, disseminate, and make available my personal information for purposes of rendering the services.
Retain my personal information for the duration of the business relationship and for such period after the termination of the business relationship as stipulated in the relevant legislation applicable to an attorney firm. Send newsletters, blogs, my personal information for the duration of the business relationship and for such period after the termination of the business relationship as stipulated in the relevant legislation applicable to an attorney firm.
I confirm that:
- I understand that I am obliged to inform the firm of any correction or deletion of personal information or destroying or deletion of record of personal information in terms of Section 24(1) of the POPI Act, by submitting Form 2 of the Regulations Relating to the POPI Act.
- I understand the contents hereof and accept this consent as adequate notification of the collection and processing of my personal information by the firm.
- I consent to the destruction or deletion of my personal information once the information is no longer required, and the retention period required by legislation has lapsed.
- The consequences of failing and/or refusing to provide consent to the firm have been explained to me and I understand that the firm will not be able to render the services to me unless I grant my consent to process the personal information.
- I may withdraw this consent or object to the processing of my personal information at any time by giving written notification to the firm’s POPI Information Officer, Jeannine Coetzee, at Jeannine@jaclaw.co.za
- JA Coetzee Attorneys, as a firm of attorneys, has the privilege of confidentiality under the law pertaining to its clients.
- I agree and acknowledge that my personal information may be used and share with the relevant Council /Local Authority, Trustees/ Managing Agent of the Scheme/Complex/Home Owners Association, South African Revenue Services, Deeds Office, Bond Registration Attorney, Rates Consultants, The Purchasers/Sellers, and Correspondent Attorneys and that my information may be captured and stored on the software programs devised to generate transfer documents, transfer duty receipts, rates clearance figures/ receipts.
- I further agree and acknowledge that the said attorneys would be required to keep my personal information for a period not exceeding 7 (seven) years or such period as may be prescribed by law whereafter it will be destroyed.
- I confirm that my consent is freely given and that I understand the contents of this consent so given.
- I hereby consent to receiving Newsletters and/or other useful information from JA COETZEE ATTORNEYS in the future
